    CONTRAT DE LICENCE 

     

    License. KYOCERA Document Solutions Canada, Ltd. (" KYOCERA ") vous accorde une licence non exclusive et non transférable pour l'utilisation des pilotes de périphériques et des logiciels d'application téléchargeables disponibles sur ce site (tous désignés ici par le terme " logiciel ").  Le terme " utiliser " signifie stocker, charger, installer, exécuter ou afficher le logiciel.

     

    Vous n'êtes pas autorisé à :

    a)    modifier, traduire, faire de l'ingénierie inverse, décompiler, désassembler, créer des œuvres dérivées basées sur, ou copier (à l'exception de la copie de sauvegarde) le Logiciel ;

    b)    louer, transférer ou accorder des droits sur le logiciel sous quelque forme que ce soit à toute personne sans le consentement écrit préalable de KYOCERA ;

    c)     supprimer tout avis, étiquette ou marque de propriété sur le logiciel ;

    d)    publier le logiciel à tout endroit accessible électroniquement au grand public, y compris, mais sans s'y limiter, les babillards électroniques, les sites Web et les sites FTP. 

    Cette licence ne constitue pas une vente. Le titre et les droits d'auteur du logiciel et de toute copie effectuée par vous demeurent la propriété de KYOCERA ou de ses concédants de licence. La copie non autorisée du logiciel ou le non-respect des restrictions ci-dessus entraînera la résiliation automatique de cette licence et mettra à la disposition de KYOCERA d'autres recours juridiques.

     

    Droits d'auteur. Le droit d'auteur et tous les autres droits relatifs au logiciel et à ses copies ou à toute partie de celui-ci sont la propriété de KYOCERA ou de ses concédants. Il vous est interdit de supprimer ou de retirer l'avis de droit d'auteur apposé dans ce paquet ou décrit dans le logiciel.

     

    Clause de non-responsabilité. LE LOGICIEL EST CONCÉDÉ SOUS LICENCE "TEL QUEL". TOUTES LES GARANTIES ET CONDITIONS IMPLICITES (Y COMPRIS TOUTE GARANTIE IMPLICITE DE QUALITÉ MARCHANDE OU D'ADÉQUATION À UN USAGE PARTICULIER) SONT REJETÉES. EN AUCUN CAS, KYOCERA (OU SES SOCIÉTÉS MÈRES OU AFFILIÉES) NE POURRA ÊTRE TENU POUR RESPONSABLE DE TOUT DOMMAGE CONSÉCUTIF, ACCIDENTEL OU INDIRECT (Y COMPRIS LES DOMMAGES POUR PERTE DE BÉNÉFICES, INTERRUPTION D'ACTIVITÉ, PERTE D'INFORMATIONS COMMERCIALES ET AUTRES), QU'IL SOIT PRÉVISIBLE OU NON, RÉSULTANT DE L'UTILISATION OU DE L'IMPOSSIBILITÉ D'UTILISER LE LOGICIEL.

     

    Exigences en matière d'exportation. Vous n'êtes pas autorisé à utiliser, exporter ou réexporter le logiciel ou toute copie ou adaptation en violation de toute loi ou réglementation applicable.  Plus précisément, vous n'êtes pas autorisé à exporter ou à réexporter le logiciel vers un pays à l'égard duquel les États-Unis ont décrété un embargo sur ses marchandises ; vous n'êtes pas non plus autorisé à distribuer le logiciel à une personne figurant sur le tableau des ordonnances de refus, la liste des entités ou la liste des ressortissants spécialement désignés.  En téléchargeant ou en utilisant le logiciel, vous certifiez que vous avez le droit d'utiliser le logiciel sans enfreindre les lois ou les règlements et que vous n'enfreindrez pas cette restriction des exigences d'exportation. 

     

    Droits restreints du gouvernement des États-Unis. Le logiciel a été développé entièrement à titre privé et est fourni en tant que " logiciel informatique commercial " ou " logiciel informatique restreint ".  Il est fourni sous licence en tant que " logiciel informatique commercial " tel que défini dans les normes DFARS 252.227-7013 (octobre 1988), DFARS 252.211-7015 (mai 1991) ou DFARS 252.227-7014 (juin 1995), en tant qu'" article commercial " tel que défini dans la norme FAR 2.101 (a), ou en tant que " logiciel informatique restreint " tel que défini dans la norme FAR 52.227-19 (juin 1987) (ou toute autre réglementation ou clause contractuelle équivalente), selon le cas. Vous ne disposez que des droits prévus pour le Logiciel tels que définis dans le présent Contrat de licence. 

     

    Résiliation. Cette licence sera résiliée immédiatement sans préavis par KYOCERA si vous ne respectez pas l'une des dispositions du présent contrat. À la suite de cette résiliation, vous devez détruire le logiciel, tous les documents écrits qui l'accompagnent et les copies.
